LLB426 Legislative Drafting

This course trains students to understand and be competent in the processes of drafting legislation. It emphasises the importance of detail and grammar to the effectiveness of a legislation’s control over citizen behaviour in respect of the legislation’s subject matter

The course will enable students:

  1. Understand the role of drafting in the legislative process
  2. Correctly identify the type of legislative document required to meet particular policy objectives
  3. Competently draft legislation and subsidiary legislation
  • Structure And Format of Bills and Acts
  • Writing Legislative Sentences
  • Drafting Compliance Provisions
  • Drafting Titles, Preambles, And Words of Enactment
  • Drafting Commencement and Duration Provisions
  • Drafting Interpretation Provisions
  • Drafting Application Provisions?
  • Drafting Amending Provisions, Saving Other Transitional Provisions
  • Drafting Subsidiary Legislation
  • Drafting Schedules
