LLB425 Equity &Trusts

This course is a comprehensive inquiry into the Law of Equity, a component of legal systems that supplements and complements common law principles. Students will delve into the historical evolution of equity, its fundamental doctrines, and the equitable remedies available to address legal disputes. Through a combination of theoretical analysis, case studies, and practical applications, students will gain a profound understanding of the principles that underpin equity, its relevance in modern legal practice, and its contribution to the development of a just legal system

By the end of the course, students should be able to:

  1. Explore the historical development of equity and its role in the legal system of Ghana and mortgages in Ghana
  2. Appreciate the maxims of Equity and their correct usage
  3. Examine the essential elements of a trust, including the settlor trustee, beneficiary, and trust property
  4. Understand the legal requirements for creating, interpreting, and enforcing trusts under Ghanaian law
  5. Demonstrate knowledge of the nature and formalities of mortgages
  • Origins and Historical Development of the Law of Equity
  • Maxims of Equity
  • Remedies
  • History and Nature of Trusts
  • Creation of Trusts (Private, Constructive, Resulting, Secret, Charitable, Public and Private Trusts)
  • Trustees and Beneficiaries (Rights and Duties)
  • Mortgages (Creation, Rights and Duties of Parties to a Mortgage, and Priority of Mortgages).
